have clarifications regarding 8.4.1, do we need to specify these requirement in our ESD control program if we are not into work under DoD?

If you do not have contracts with the United States Department of Defense, then section 8.4.1 does not apply. The assessor may ask the question, does the organization perform work under US DOD contracts? If the answer is no, then section 8.4.1 does not apply.

No, no statement is required. If the assessor asks about it just answer that the company does not have any contracts with the United States Department of Defense.

You can refer them to this information if you like. You could ask them for an interpretation from the ESD Association. That would be more formal.
